
The government have passed emergency legislation via a statutory instrument to amend the Statutory Sick Pay (General) Regulations 1982 (“the 1982 Regulations”).
Regulation 2(1) provides categories of people to be treated as incapable of work for the purposes of claiming statutory sick pay.
These Regulations provide that a person who is isolating from others in accordance with advice on coronavirus disease is deemed to be incapable of work. They are sick!
This temporary measure is currently indicated to expire on 12th November 2020 (after 8 months).
Yet to come
This statutory instrument does not implement day 1 SSP rights or cover the under 250 employee for up to 14 days SSP recovery. It is anticipated that these will be introduced shortly and will also be applicable from Friday 13th March 2020 retrospectively once the additional emergency legislation has been laid.
